Website and Online Service Terms and Conditions of Use
These Terms and Conditions of Use (“Agreement”) are a legal agreement between you and AZ Locums (“Website Owner”), the owner and operator of this website and each of its subdomains, subdirectories, and related file paths (collectively, “the Website”). By registering for, accessing, or using any service provided on the Website, you become a user (“User” or “You”) and agree to be bound by these Terms for as long as you use our services. If you do not agree, do not register for or use any AZ Locums service or the Website.

1. Limitations of Liability
You agree that the Website, Website Owner, its subsidiaries, affiliates, licensors, service providers, employees, agents, officers, and directors will not be liable under this Agreement for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including loss of revenue or income, even if Website Owner has been advised of the possibility of such damages or was grossly negligent. In no event will collective liability exceed the fees paid by you to Website Owner for the applicable service out of which such liability arose. AZ Locums, its employees, agents, affiliates, and hosting services are not responsible for unauthorized transmissions or release of such information by others.
5. Confidentiality
Personal information given to AZ Locums will be kept confidential except where: (1) you choose to post information publicly; (2) you authorize disclosure to healthcare facilities or partners for placement purposes; (3) disclosure is required by law or court order; or (4) you violate this Agreement or harass others using Website services. You may not use Website services to compromise security or tamper with systems, resources, or accounts. AZ Locums reserves the right to investigate suspected violations and cooperate with law enforcement.
6. Ownership, Copyrights, Trademarks & Proprietary Information
You acknowledge that the Website and software used in connection with it contain proprietary and confidential information owned by AZ Locums and protected by applicable intellectual property laws. No rights or title to such information are transferred to you. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on Website services or software. Trademarks, service marks, logos, and copyrighted works on the Website are the property of AZ Locums.
7. No Warranties
Use of the Website and any service it provides is at your sole risk. The Website and its services are provided on an “as is” and “as available” basis. AZ Locums expressly disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 8. Placements & Credentialing
Job listings, rates, schedules, and assignment details are subject to change based on facility requirements. Credentialing, privileging, licensure verification, and compliance documentation must be completed before any clinical assignment begins. Nothing on this Website constitutes a guarantee of placement, compensation, privileging, or assignment duration.
9. Communications & SMS
By submitting forms on this Website, you consent to being contacted by AZ Locums regarding your inquiry, including by phone, email, or SMS where permitted. Message frequency may vary. 10. Jurisdiction
This Agreement and any disputes arising from it are governed by Arizona law, without regard to conflict-of-law provisions. Any lawsuit arising from or related to this Agreement shall be brought in a court of competent jurisdiction in Arizona, and you consent to that jurisdiction. To the extent permitted by law, you waive any right to trial by jury with respect to any claim arising from this Agreement. Any claim must be filed within one (1) year after it arose.
11. Severability
If any part of this Agreement is found unlawful, void, or unenforceable, that part will be severable and will not affect the validity of remaining provisions. The unenforceable provision will be modified to be valid and enforceable while giving fullest effect to the original intent.
12. Age Certification
You must be at least 18 years of age to register, access, or use any Website service related to Locum placements or clinical staffing. If you are under 18, do not use this Website for such purposes.
13. Entire Agreement
This Agreement, together with the Privacy Policy, constitutes the entire agreement regarding the Website and its services and supersedes prior communications and proposals. You may also be subject to additional posted terms when you use specific services. AZ Locums may revise these Terms at any time; continued use after changes signifies acceptance.
14. Waiver
Failure of AZ Locums to exercise or enforce any right or provision does not operate as a waiver. Any waiver must be in writing and signed by an authorized representative of AZ Locums.
